Об особенностях оформления пенсии по возрасту на брифинге в РСК рассказал заместитель директора филиала НАО «Государственная корпорация «Правительство для граждан» Виталий Городецкий. В соответствии с нормами Социального кодекса Республики Казахстан от 20 апреля 2023 года назначение пенсионных выплат по возрасту производится мужчинам по достижении 63 лет, женщинам с 1 января 2023 года – 61 года. Однако с 1 января 2028 года для женщин начнется поэтапное увеличение на пять месяцев. Так, с 2031 года женщины будут получать выплаты по достижении 63 лет.
Для получения консультации по вопросам пенсионных выплат, проверки документов и предварительного расчета пенсионных выплат по возрасту граждане могут обратиться в Государственную корпорацию «Правительство для граждан» за три месяца до достижения пенсионного возраста. При себе необходимо иметь трудовую книжку, дипломы об окончании учебных заведений, для мужчин – военный билет, для женщин – свидетельства о рождении детей, браке/расторжении брака.
Для подачи заявления на назначение пенсионных выплат услугополучатель может обратиться в любой отдел по обслуживанию населения независимо от места регистрации с необходимым пакетом документов.
Также для назначения государственной базовой пенсионной выплаты заявление можно подать через портал электронного правительства.
Необходимо отметить, что пенсия состоит из трёх частей. Первая – солидарная пенсия, которая рассчитывается от стажа за период до 1 января 1998 года, то есть до вступления в силу накопительной системы и среднемесячного дохода за любые три года подряд независимо от перерывов в работе с 1 января 1998 года.
Вторая часть – это базовая пенсионная выплата (БПВ), для ее расчёта учитывается стаж как до 1 января 1998 года, так и после. Размер БПВ составляет при наличии десяти и менее лет стажа участия в пенсионной системе либо его отсутствии в размере 60 процентов от величины прожиточного минимума – 24 341 тенге. Ее размер увеличивается за каждый полный год стажа участия в пенсионной системе сверх десяти лет на 2 процента, но не более 100 процентов от величины прожиточного минимума – 40 567 тенге, установленной на соответствующий финансовый год законом о республиканском бюджете. Данные показатели БПВ будут повышаться ежегодно по 2027 год включительно.
«С 1 января 2024 года увеличатся на 5% и составят 65 и 105 процентов от прожиточного минимума, а с 2027 года с учётом ежегодных повышений БПВ составит при наличии десяти и менее лет стажа участия в пенсионной системе либо его отсутствии 70 процентов от величины ПМ. Увеличиваться ее размер будет за каждый полный год стажа участия в пенсионной системе сверх десяти лет на 2 процента, но не более 120 процентов от величины ПМ», – сказал Виталий Городецкий.
Третья часть – это выплаты с Единого накопительного пенсионного фонда, за счёт накоплений, сформированных из перечислений в ЕНПФ.
Доход, учитываемый для расчёта солидарной пенсии, не может превышать размера 55-кратного месячного расчетного показателя, установленного на соответствующий финансовый год Законом о Республиканском бюджете или 189 750 тенге.
Если доход предоставляется с нескольких организаций, то необходимо также документальное подтверждение дохода от каждой организации, это может быть записано в трудовой книжке либо в трудовом договоре.
Размер среднемесячного дохода устанавливается соответственно тому, с которого осуществлялись обязательные пенсионные взносы в Единый накопительный пенсионный фонд, социальным отчислениям в фонд в порядке, определяемом уполномоченным государственным органом.
В случаях, если в трудовой книжке выявляются несоответствия в анкетных данных, изменения записей о фамилии, имени, отчестве (при его наличии) и дате рождения работника производится работодателем по последнему месту работы на основании документов, удостоверяющих личность, свидетельства о браке, расторжении брака, об изменении фамилии, имени, отчества. Если организация закрыта, то трудовой стаж подтверждается архивной справкой.
Государственная услуга по выдаче архивных справок, копий архивных документов или архивных выписок оказывается государственными архивами РК. Прием заявления и выдача результата оказания государственной услуги осуществляются через некоммерческое акционерное общество «Государственная корпорация «Правительство для граждан», веб-портал «электронного правительства» www.egov.kz
При отсутствии в архиве сведений, подтверждающих стаж работы, трудовой стаж подтверждается в судебном порядке.
Для расчёта БПВ учитываются трудовой стаж, выработанный за период до 1 января 1998 года, период, за который осуществлялись обязательные пенсионные взносы в ЕНПФ, время ухода неработающей матери или неработающего отца (при осуществлении им фактического ухода) за малолетними детьми, но не более чем до достижения каждым ребенком возраста 3 лет в пределах 12 лет в общей сложности. Также время ухода за ребенком с инвалидностью в возрасте до 18 лет, периоды воинской службы, службы в специальных государственных и правоохранительных органах, государственной фельдъегерской службы. И время ухода за лицом с инвалидностью первой группы, одиноким лицом с инвалидностью второй группы и пенсионером по возрасту, нуждающимися в посторонней помощи, а также за престарелым, достигшим восьмидесятилетнего возраста.
Представление решения суда не требуется при подтверждении государственными информационными системами сведений о получении ежемесячного государственного пособия, назначаемого и выплачиваемого матери или отцу, усыновителю (удочерителю), опекуну (попечителю), воспитывающему ребенка с инвалидностью, лицу, осуществляющему уход за лицом с инвалидностью первой группы.
При неполном или несвоевременном перечислении обязательных пенсионных взносов в ЕНПФ работодателем период осуществления обязательных пенсионных взносов подтверждается (в зависимости от их наличия) рядом документов. Это – справка работодателя (правопреемника) о перечислении обязательных пенсионных взносов по установленной форме или архивного учреждения о перечислении обязательных пенсионных взносов (при условии соответствия периодов перечисления обязательных пенсионных взносов периодам трудовой деятельности, указанным в документах, подтверждающих трудовой стаж заявителя) либо решением суда, подтверждающим период перечисления обязательных пенсионных взносов.
